End User License Agreement

This End User License Agreement ("Agreement") governs your use of affiliateOS and its Vercel integration (together, the "Service"). It is between you and Choix Media LLC, the operator of affiliateOS ("we", "us", or "our"). Our homepage is affiliate-os.com. General use of affiliateOS is also governed by our Terms of Service.

By installing, connecting, or using the Service, you agree to this Agreement. If you use the Service for an organization, you confirm that you have authority to accept it on that organization's behalf. If you do not agree, do not install or use the Service.

1. License and ownership

Subject to this Agreement and any applicable subscription terms, we grant you a limited, non-exclusive, worldwide, non-transferable license to access and use the Service for your organization's business operations during your authorized subscription or access period. You may allow your authorized team members to use the Service on your behalf. We and our licensors retain ownership of the Service and all rights not expressly granted. Third-party and open-source components remain subject to their own licenses.

2. Accounts and authorized use

You are responsible for your account, your team members' use of the Service, and keeping credentials secure. Connect only accounts, teams, projects, and domains that you are authorized to manage. You are responsible for reviewing the actions you request, including publishing websites, changing configuration, and removing resources.

3. Vercel integration and permissions

Connecting Vercel authorizes affiliateOS to access the Vercel account or team covered by your installation, within the permissions you grant. The integration requests access to all projects so it can create projects for websites you connect to affiliateOS. Its permissions include:

  • Read and write projects, including creating projects and deleting them on unbind.
  • Upload website files, create deployments, and read deployment status and URLs.
  • Read and write project environment variables, including site credentials and content endpoint configuration.
  • Add, inspect, verify, and remove custom domains associated with projects.
  • Read user, team, and installation details to identify and manage the connection.
  • Configure project preview protection and create access secrets for preview checks.

The Service stores the connection credential in encrypted form and retains connection identifiers, account or team details, and operational records needed to manage your websites. It sends website files and configuration to Vercel when you request a deployment. Grant access only if you are authorized to share this information and permit these actions.

Vercel is a separate service governed by its own terms. This Agreement is solely between you and the affiliateOS provider. Vercel is not a party to it and has no responsibility or liability under this Agreement for affiliateOS or its support.

4. Your content and data

You retain ownership of the content and data you provide. You authorize us to host, process, and transmit that content and data as needed to provide the Service and carry out your instructions. You are responsible for having the necessary rights, notices, and consents for that processing. Personal information is also subject to our Privacy Policy and any applicable data processing agreement.

5. Acceptable use

You must comply with applicable law and the terms of connected providers. You must not use the Service to distribute malware, infringe others' rights, conduct fraud, access systems without authorization, bypass security or usage limits, or disrupt the Service. You must not resell the Service or reverse engineer it except where permitted by applicable law or a separate license. You remain responsible for the legality of your websites, advertising, affiliate content, and disclosures in each market you serve.

6. Fees and third-party services

Any affiliateOS fees and usage allowances are set out in your subscription or other commercial agreement. Installing the integration does not include a Vercel subscription or waive hosting, domain, or other third-party charges. You are responsible for charges incurred through the resources and actions you authorize.

7. Availability and warranties

The Service may change and may be unavailable during maintenance or due to third-party failures. Preview and beta features may be incomplete. Except as expressly agreed in writing, and to the extent permitted by law, the Service is provided "as is" and "as available", without warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted operation, error-free results, or any advertising, revenue, or business outcome.

8. Limitation of liability

To the extent permitted by law, neither party is liable under this Agreement for indirect, incidental, special, or consequential loss, or loss of profits, revenue, goodwill, or business opportunities. Nothing in this Agreement excludes or limits liability for fraud, willful misconduct, or any liability or statutory right that cannot lawfully be excluded or limited. Any liability terms in a separate written agreement between you and us take precedence.

9. Disconnection and termination

You may stop using the Service at any time. Disconnecting Vercel in affiliateOS removes the stored connection credential and disables that connection. You can also revoke the installation from your Vercel dashboard. Disconnection does not itself delete existing Vercel projects, deployments, or domains, cancel subscriptions, or stop third-party charges; manage those resources and subscriptions separately.

We may suspend or terminate access for a material breach of this Agreement, a security risk, or a legal requirement. When your access ends, the license granted here ends. Provisions concerning ownership, accrued payment obligations, warranty disclaimers, and liability survive termination.

10. Changes to this Agreement

We may update this Agreement by publishing a revised version with a new date. We will provide notice of material changes through the Service or your account contact before they take effect, where required by law. Continued use after changes take effect constitutes acceptance, subject to any consent requirements under applicable law. If you do not agree to the revised terms, stop using and disconnect the Service.

11. General terms

A separate written agreement with us controls if it conflicts with this Agreement. If any provision is unenforceable, the remaining provisions continue in effect. A failure to enforce a provision does not waive the right to enforce it later. This Agreement does not limit any mandatory protections available to you under applicable law.
